HSX has seen a number of trolls posting on the HSX Boards over the years.  The most common defense that is brought up when a troll is confronted about their behavior is that they are protected by the First Amendment of the United States Constitution which allows them "freedom of speech" which they interpret as meaning that they are allowed to say anything they want.


There are two points that HSXsanity would like to point out about these situations.


First, HSXsanity would like to point out in general that the First Amendment is not a blanket statement that simply allows anybody to say anything that they like. 

It is against Federal Law to verbally threaten the safety of the US President (for example).  It is against the law to provide false testimony in court.  You can be held responisble for slandering somebody's character in public.  Profanity is not allowed on publically broadcasted US television stations.  These are just a few random examples where "free speech" does have some limitations.

Second, HSXsanity would like to point out that HSX is not considered a public place.  This is a game run by a company and each player agreed to follow the terms of a contract (Terms Of Use) when they applied for an account.  The Terms Of Use that players agreed to follow outlines behavior that is considered unacceptable within this game. Players who violate the Terms Of Use can be punished by HSX (by a fine to their port; scribbling of their post(s) on the HSX Boards; not being allowed to post on the HSX Boards; account suspension; account deletion; ban from the game).


Most of the behavior that would violate a player following HSX's Term Of Service are things that players should know from common sense:

don't try to cheat; don't harrass/stalk other players; do not disrupt another player from being able to play the game; do not intentionally post false news on the boards to manipulate prices; do not spam the boards; do not harrass other players because of their race, gender, sexual preference, age, religion, ethnicity, disability, etc...


The purpose of HSXsanity's post was to point out that trollish behavior does not have to simply be tolerated by HSX (or HSX Players) because a troll shouts that they can say anything because of the First Amendment.  Bad behavior can (and should) be punished by HSX (as needed).
